Parent Appeal to the Manifestation Determination
If parents disagree with the manifestation determination, they have the right to appeal the decision and request a new hearing. The district will arrange for an expedited hearing. The Peoria District will use a non-district contracted hearing officer for appeals. The student will remain in his or her current placement until the hearing is completed. The hearing officer will have the authority to place the student in an interim alternative setting during the appeal process if the student is likely to be injured or injure others.

Appeal Procedure:

  1. The student's parents will make a verbal or written appeal to the special education director and superintendent.

  2. The special education director or designee will appoint a hearing officer and schedule a hearing.

  3. The special education director or designee will send the parents prior written notice, a meeting notice, and procedural safeguards.

  4. The special education director or designee will notify the IEP team.

  5. The manifestation hearing officer and IEP team will conduct a manifestation hearing and complete Form SP130.
